This privacy notice applies to the website operated by Plains Commerce Bank, referred to as "Plains Commerce Bank" herein.

PURPOSE

Plains Commerce Bank (Bank), its subsidiaries, affiliates, successors, assigns, or any third parties acting on the Bank’s behalf provides you with this Privacy Policy (Policy), in combination with other relevant privacy notices that the Bank provides to you (e.g., pursuant to financial privacy laws), to inform you of the policies and practices regarding the collection, use, retention, protection, and disclosure of your personal information (Personal Information) that the Bank collects from or about you and process in connection with the Bank’s website, mobile application, other online or offline offerings, communications, or through other platforms and programs that link to this Policy  (Services). By using the Bank’s Services or any of the products and services, you accept this Policy. If you do not agree to this Policy, you must cease using the Bank’s Services immediately. 

California Notice at Collection

The Bank collects the categories of Personal Information as described under the “The Types of Personal Information We Collect” section below. The Bank uses these categories of Personal Information for the purposes as described under the “How We Use Your Personal Information” section below, and the Bank discloses it as described under “Disclosure of Your Personal Information”. The Bank does not sell, but may share your Personal Information for cross-context behavioral advertising. You may opt-out of such sharing by clicking on “Do Not Share My Personal Information for Cross-Context Behavioral Advertising”. The Bank retains your Personal Information as described under the Safeguards and Retention” section below.  

POLICY STATEMENT

The Types of Personal Information We collect

Through your use of the Services, the Bank may collect Personal Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you in the following ways:

(a) Personal Information You Provide to the Bank.

  • The Bank may collect Personal Information from you, such as your first and last name, address, e-mail, telephone number, and Social Security number when you create an account.
  • The Bank will collect the financial and transaction information necessary to provide you with the Services, including account numbers, payment card expiration date, payment card identification, verification numbers, and transaction and payment history.
  • Biometric information.
  • Education information, defined as information that is not publicly available personally identifiable information.
  • Sensitive Personal Information, such as your Social Security number, driver’s license number, state identification card number, passport number, racial or ethnic origin, citizenship or immigration status, account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account, sexual orientation, status as transgender or nonbinary.
  • If you provide feedback or contact the Bank via email, the Bank will collect your name and email address, as well as any other content included in the email, in order to send you a reply.
  • The Bank also collects other types of Personal Information that you provide voluntarily, such as any Personal Information requested by the Bank if you contact the Bank via email regarding support for the Services.

(b) Personal Information Collected from Third Parties. The Bank may collect certain Personal Information from identity verification services, consumer reporting agencies including credit bureaus, advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, social networks, and data brokers in order to provide some of the Bank’s Services.

(c) Personal Information Collected Via Technology. The Bank and its service providers may automatically log information about you, your computer or mobile device, and your interaction over time with Bank Services, Bank communications and other online Services, such as:

  • device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers, language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and general location information such as city, state or geographic area.
  • online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times, browser type, language preference, referring site and date, and duration of access.
  • cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping the Bank understand user activity and patterns.
  • local storage technologies, like HTML5 and Flash, which provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
  • web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.
  • location Information. If you have enabled location services on your phone and agree to the collection of your location when prompted by the Services, the Bank will collect location data when you use the Services even when the mobile application is closed or not in use; for example, to provide Bank fraud detection services. If you do not want the Bank to collect this information, you may decline the collection of your location when prompted or adjust the location services settings on your device.

How We Use Your Personal Information

(a) General Use. In general, the Bank uses your Personal Information collected through your use of the Services to respond to your requests as submitted through the Services, to provide you the Services you request, and to help serve you better. The Bank uses your Personal Information, in connection with the Services, in the following ways:

  • facilitate the creation of, and secure and maintain your account;
  • identify you as a legitimate user in the Bank’s system;
  • provide improved administration of the Services;
  • debug to identify and repair errors with the Bank’s Services;
  • provide the Services you request;
  • improve the quality of experience when you interact with the Services;
  • send you administrative e-mail notifications, such as security or support and maintenance advisories;
  • conduct audits relating to interactions, transactions, and other compliance activities
  • enforce Bank agreements and policies;
  • send surveys, offers, and other promotional materials related to the Services; and
  • for other legitimate business purposes unless otherwise prohibited by law.

(b) Compliance and protection. The Bank may use your Personal Information to:

  • comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities;
  • protect the Bank’s, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • audit Bank internal processes for compliance with legal and contractual requirements and internal policies;
  • enforce the terms and conditions that govern the Service; and
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

(c) Creation of Non-Identifiable Data. The Services may create de-identified information records from Personal Information by excluding certain information (such as your name) that makes the information personally identifiable to you. The Bank may use this information in a form that does not personally identify you to analyze request patterns and usage patterns to enhance Bank products and services. The Bank reserves the right to use and disclose non-identifiable information to third parties at the Bank’s discretion. If the Bank de-identifies your Personal Information, the Bank publicly commits to retain and use the de-identified Personal Information without attempting to re-identify the de-identified Personal Information.

(d) With your consent. The Bank may use Personal Information for other purposes that are clearly disclosed to you at the time you provide Personal Information for which you provide consent.

Sensitive Personal Information is Personal Information that includes a Social Security number, driver’s license number, government issued identification number, credit card number, bank account or other financial institution account number, or username and password. Please note that the Bank does not use your Sensitive Personal Information to infer characteristics about you.

Disclosure of Your Personal Information

The Bank discloses your Personal Information collected through your use of the Services as described below.

(a) In Accordance with the Bank’s Other Privacy Notices. Other than as described in this Policy in connection with the Services, this Policy does not apply to the processing of your Personal Information by the Bank or third parties with whom the Bank discloses information. For more information about our financial privacy practices, please visit our Privacy Notice.

(b) Third Party Service Providers. The Bank may disclose your Personal Information with third party or affiliated service providers that perform services for or on behalf of the Bank in providing the Services, for the purposes described in this Policy, including: to provide you with the Services; to conduct quality assurance testing; to facilitate the creation of accounts; to optimize the performance of the Services; to provide technical support; and/or to provide other Services.

(c) Authorities and Others. Regardless of any choices you make regarding your Personal Information, the Bank may disclose your Personal Information to law enforcement, government authorities, and private parties, for the compliance and protection services described above.

(d) Merger, sale, or other asset transfers. The Bank may disclose your Personal Information If the Bank is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, as part of such a transaction, as permitted by law and/or contract.

(e) For legitimate business purposes. The Bank may disclosure your Personal information with other third parties; such as advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, social networks, and data brokers; as appropriate to further the Bank’s legitimate business purposes.

To the extent that the Bank discloses your Personal Information, the Bank may disclose any of the above categories of Personal Information to any of the above described third parties for any business or commercial purpose. 

Cookies and Tracking Technologies 

The Bank uses cookies and similar tracking technologies to collect Personal Information about your interactions with the Services. This allows the Bank to improve your experience and track usage patterns. Cookies are small files that are stored on your device browsers that store preferences and facilitate and enhance your experience. You can choose to accept or decline cookies through your browser settings.

What Are Cookies? A cookie is a string of information that a website stores on a visitor's computer, and that the visitor's browser provides to the website each time the visitor returns. Because the browser provides this cookie information to the website at each visit, cookies serve as a sort of label that allows a website to "recognize" a browser when it returns to the site. The domain name in Plains Commerce Bank cookies will clearly identify their affiliation with the Bank and, where applicable, its third-party service provider.

How the Bank Uses Cookies. The Bank's Services use cookies to help the Bank identify and track visitors, their usage of Services, and their Service access preferences across multiple requests and visits. The basic idea is to gather aggregate data about how people use Bank Services. The term usually used to describe this is "web analytics" and the cookies are the tools by which a website owner collects this web analytics data.

The Bank will use the web analytics data only to determine aggregate usage patterns for the Bank’s website as described above. The Bank does this by using either the Bank’s own internal analytics software or by sending this information to a third-party service provider to help the Bank analyze this data. The Bank has agreements with its third-party service providers that they will not disclose this information with others or use the information for purposes other than to maintain the services they provide to the Bank. It is possible to link cookies to Personal Information, thereby permitting website operators, including Bank third-party analytics providers, to track the online movements of particular individuals. The Bank does not do so and its third-party service providers are not allowed to correlate the Bank’s data with any other data.

The Bank uses the information provided by cookies to develop a better understanding of how visitors use Bank Services, and to facilitate those visitors' interactions. The Bank may make the aggregate data obtained from web analytics (including from Bank third-party analytics providers, if applicable) publicly available. If this data is made available, none of the information will be personally identifying information or potentially-personally identifying information.

How to Control the Use of Cookies. You have the right to accept or decline cookies. Bank Service users who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before linking to Bank Services. Certain features of the Bank’s website may not function properly without the aid of cookies.

Your Choices Regarding Your Information

You have several choices regarding use of information on the Services.

(a) How the Bank Responds to Do Not Track Signals. Some web browsers transmit “do not track” signals to the websites and other online services with which your web browser communicates. There is currently no standard that governs what, if anything, websites should do when they receive these signals. The Bank currently does not take action in response to “do not track” signals. The Bank endeavors to honor opt-out preference signals, such as the Global Privacy Control. If and when a standard is established, the Bank may revise its policy on responding to these signals.

(b) Access, Update, Delete or Correct Your Information. You can access, update, or correct your information by changing preferences in your account. The Bank is required to verify your identity before responding to such requests. For additional requests, please contact the Bank.

(c) Opting Out of Email or SMS Communications. If you have signed-up to receive the Bank’s email marketing communications, you can unsubscribe any time by clicking the "unsubscribe" link included at the bottom of the email or other electronic communication. Alternatively, you can opt out of receiving marketing communications by contacting the Bank at the contact information under "Contact Us" below. If you provide your phone number through the Services, the Bank may send you notifications by SMS, such as provide a fraud alert. You may opt out of SMS communications by unlinking your mobile phone number through the Services.

(d) Opting Out of Geolocation Tracking. If you initially consented to the collection of geo-location information through the Services, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. Please note, however, that if you withdraw consent to the Bank’s collection of location information, you may no longer be able to use some features of the Services.

(e) Opting Out of Google Analytics. If you do not want data about your visits to the Bank’s website to be collected by Google Analytics, you can install the Google Analytics Opt-out Browser Add-on. The add-on keeps your visits anonymous and prohibits any data from being sent to Google Analytics. To learn more about Google’s privacy policy, please visit: http://www.google.com/policies/privacy.

Your State Privacy Rights

Depending on your state of residence and applicable laws, you may have certain rights regarding your Personal Information:

Access/Know. You may have the right to request access to the Personal Information the Bank holds about you. You may be able to request a list of specific third parties to which the Bank has disclosed your Personal Information.

  • Request Correction. You may have the right to request corrections to any inaccurate or incomplete Personal Information.
  • Request Deletion. You can request that the Bank delete your Personal Information, subject to applicable legal obligations.
  • Opt-Out of Sales or Sharing for Cross-Contextual Advertising. You may opt out of the sale or sharing (as such term is defined under applicable law) of your Personal Information for cross-contextual behavioral advertising. Such opt-out right may be available through an opt-out preference signal.
  • Limit the Use and Disclosure of Sensitive Personal Information. If the Bank uses or disclose Sensitive Personal Information for purposes other than those permitted under applicable law, you can request to limit such activities.
  • Non-Discrimination and Non-Retaliation. You will not be discriminated or retaliated against for exercising your privacy rights.

When making a privacy request, please be prepared to provide: name, address, date of birth, and government issued ID number. The Bank will verify your identity by comparing this information to Bank business records. 

An authorized agent may submit a request on your behalf using the process as described above to exercise your privacy rights. 

Safeguards and Retention

The Bank implements reasonable administrative, technical and physical measures in an effort to safeguard the information in Bank custody and control against theft, loss and unauthorized access, use, modification and disclosure. Nevertheless, transmission via the internet is not completely secure and the Bank cannot guarantee the security of your information.

The Bank discloses collected Personal Information only to those of its employees, contractors, service providers, and subsidiaries that need to know that information in order to process it on the Bank’s behalf and that have agreed not to disclose it to others. Additionally, the Bank may need to transfer personally identifying information to an affiliate or successor in the event of a change of the Bank’s corporate structure or status, such as in the event of a restructuring, sale, or bankruptcy. The Bank will retain any personally identifying information for the period necessary to fulfill the purposes outlined in this Policy. The Bank does not rent or sell personally identifying information to anyone.

By using the Services or providing Personal Information to the Bank, you agree that the Bank may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Bank’s Services. If the Bank learns of a security system’s breach, the Bank may attempt to notify you electronically by posting a notice on the Bank’s Services, by mail, or by sending an email to you.

The Bank stores the Personal Information collected as described in this Policy for as long as you use the Services, or as necessary to fulfill the purpose(s) for which it was collected, provide the Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce Bank agreements, and comply with applicable laws, or based upon other criteria, including, but not limited to, the sensitivity and volume of such data. Additionally, we endeavor to retain all such Personal Information in accordance with legal requirements.

Links to Other Third-Party Sites

The Services may contain links to third-party websites that are not controlled or operated by the Bank. This Policy does not apply to third-party websites. When you click on a link to any other website or location, you will leave the Services and go to another site and another entity may collect personal and/or anonymous information from you. The Service’s provision of a link to any other website or location is for your convenience and does not signify the Bank’s endorsement of such other website or location or its contents. The Bank has no control over, does not review or manage, and cannot be responsible for, these outside websites, their privacy policies, or their content. Please be aware that the terms of this Policy do not apply to these outside websites. The Bank encourages you to read the privacy policy of every website you visit. the Bank does not endorse or authorize any of the privacy and security practices conducted by other websites, nor is the Bank liable for any privacy practices of those websites.

A Note About Children

The Services are not directed towards individuals under the age of eighteen (18), and the Bank does not, through the Services, intentionally gather Personal Information about visitors who are under the age of eighteen (18). The Bank has no actual knowledge of selling of sharing the Personal Information of anyone under sixteen (16) years of age. If a child under eighteen (18) submits Personal Information to the Bank through the Services, and the Bank learns that the Personal Information is the information of a child under the age of eighteen (18), the Bank will attempt to delete the information as soon as possible, unless the Bank has a legal obligation to keep it. If you believe your child has provided the Bank with Personal Information, please contact the Bank to remove it.

Policy Updates

This Policy is subject to occasional revision. The Bank will notify you of any material changes in its collection, use, retention, protection, or disclosure of your Personal Information by posting a notice on the Services as required by applicable law such as by posting the updated Policy on this page with a revised "Last Updated" date. Any material changes to this Policy will be effective thirty (30) calendar days following notice of the changes on the Services. These changes will be effective immediately for new users of the Services. Continued use of the Services following notice of any such changes shall indicate your reading and acknowledgement of such changes. Please review this Policy periodically to stay informed about how the Bank is protecting your Personal Information.

Legal Processes and Other Disclosures

Consistent with this Policy, the Bank will scrutinize third party requests for information about you for compliance with the law, including those coming from governmental agencies or civil litigants. The Bank may access, use, preserve or disclose information about you only when the Bank has a good faith belief that it is reasonably necessary to do so to satisfy the applicable law, regulation, legal process or lawful governmental request of any country, or to protect the rights, property or safety of the Bank, its customers, or the public. The Bank will provide notice of legal process or governmental requests unless prohibited to do so by law or the circumstances warrant otherwise.
