Terms & Conditions - Contest Rules: Plains Commerce Bank will randomly select 10 entrants of the Piggy Bank Design Contest one (1) $50 (bonus) deposit into a Plains Commerce Bank Youth Savings Account. Entrants of the Piggy Bank Design Contest must complete the submission form and steps as listed on www.plainscommerce.com/piggy-bank between Wednesday, April 13 at 12:00 a.m. CT through Saturday, April 30 at 11:59 p.m. CT, or in person at our Aberdeen, Conde, Hoven, Mitchell, Sioux Falls, and Watertown, South Dakota locations. The Plains Commerce Bank Youth Savings Account has no minimum balance to open or maintain, no monthly service charges and earns interest at 0.05% APY. Interest rate and annual percentage yield may change. At Plains Commerce Bank’s discretion, we may change the interest rate on the account at any time. Interest begins to accrue on the business day when a non-cash item (for example, a check) is deposited into the account. Plains Commerce uses the daily-balance method to calculate the interest on the account. This method applies a daily periodic rate to the principal in the account each day. By participating in this promotion, you are consenting to Plains Commerce Bank obtaining your name, address and phone number. No recipient may make any substitution or transfer of the deposit of $50 (bonus) deposited into a Plains Commerce Bank Youth Savings Account. Plains Commerce Bank reserves the right, at our discretion, at any time, without notice or assigning any reason, therefore, replace or substitute any bonus in the promotion with any other prize of similar value selected by Plains Commerce Bank. If winner(s) of the Piggy Bank Design Contest do not open a Youth Savings Account before June 30, 2022, this will result in the forfeiture of the bonus. Plains Commerce Bank will fund the winner(s) Youth Savings Account with the $50 (bonus) within 24-hours of the account being opened. If winner(s) has a previous banking relationship with Plains Commerce Bank that includes a Youth Savings Account, Plains Commerce will deposit the $50 (bonus) into said account within 24 hours. Eligibility: Open to legal residents of United States under the age of 18. Limit one $50 (bonus) deposited into a Plains Commerce Bank Youth Savings Account per child. Customer consents to the use of their name in any manner by Plains Commerce Bank without further compensation (customer contact information is excluded and will not be used). How to Enter: To enter the Drawing, eligible individuals must submit a qualifying entry to the Piggy Bank Design Contest by 11:59 p.m. CT on April 30, 2022 (“Deadline”). Random Drawing/Odds: Ten (10) winners will be selected in a random Drawing from among all eligible entries received by Plains Commerce Bank prior to the Deadline. The random Drawing will be held no later than thirty (30) days after the Deadline. The results of the Drawing, and all decisions of Plains Commerce Bank as to the administration of the Drawing and the prize award, are final and binding in all aspects. If a winner is under the age of 18, an adult is required to open the account and claim the prize on their behalf. All potential winners are subject to eligibility verification by the Sponsor, whose decisions are final and binding in all matters related to the Drawing. An entrant is not a winner of any ‘bonus unless until the entrant’s eligibility has been verified and the entrant has been notified that verification is complete. The ‘bonus’ is non-transferrable. The Sponsor is responsible only for delivery of the ‘bonus’; not responsible for ‘bonus’ utility or otherwise. The ‘bonus’ may be considered income, and any and all taxes associated with a Prize are the responsibility of the winner. Entry Requirements: Entries must meet the following requirements to be eligible for judging: a. Piggy banks must be able to hold coins (i.e., include a slot that has been cut to insert coins). b. Piggy banks must be created or decorated by the youth contestant. c. Plastic or ceramic banks piggy banks may be used but must be personally decorated. d. Piggy banks DO NOT have to be in the shape of a pig. e. You MAY use or repurpose other containers. In addition, an Entry shall be void if it contains any material that Plains Commerce Bank in their sole discretion deem patently offensive or inappropriate, such as, but not limited to, profanity. By submitting an Entry, the parent/legal guardian of the Entrant represents and warrants that the entire Entry is the original work of the Entrant, not previously submitted or distributed elsewhere for any other purpose. The parent/legal guardian of the Entrant further warrants that he/she has obtained the consent of any persons/parties portrayed in the Entry. Sponsors shall have the right to use/showcase the Entry in any manner, in any and all media, worldwide in perpetuity without further compensation or consent. Upon request of Sponsors, the parent/legal guardian of Entrant will provide a copy of any written consent as required above. Miscellaneous and Conditions of Participation: The Drawing is void where prohibited or restricted by law, and is subject to all applicable federal, state, and local laws and regulations. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Drawing Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of South Dakota and North Dakota without regard to conflicts of law. All suits or claims brought in connection with the Drawing must be brought in a state or federal court in South Dakota or North Dakota. Taxes and fees, if any, are the sole responsibility of the winner. By entering a Drawing, entrants fully and unconditionally agree to be bound by these Official Drawing Rules and the decisions of the Sponsor, which will be final and binding on all matters relating to the Drawing, and warrant that (s)he is eligible to participate in the Drawing. The Sponsor reserves the right to disqualify any entrant if these Official Drawing Rules are not followed, change, alter, or amend these Official Drawing Rules or alter, modify, suspend, or terminate a Drawing, as necessary, in its sole discretion, to ensure the fair administration of the Drawing or to comply with applicable law. References to “winner” in these Official Drawing Rules shall mean eligible entrants and/or an adult that opens an account on behalf of an eligible entrant that is under 18 years old, as the case may be. Release: Each entrant agrees, except where prohibited by law, to release and discharge, hold harmless, and indemnify the Sponsor, its employees, agents and representatives, officers and directors and their immediate families, successors and assigns, and all others associated with the development and execution of the Drawing, from any and all tax liability that may be imposed or associated with receipt or use of the Prize, and from and against any and all claims, actions, proceedings, and liability for any damages, expenses, fees, injury, or losses sustained in connection with the receipt, ownership, use, or misuse of the Prize or while traveling to, preparing for, or participating in any Drawing-related activity. Publicity: Except were prohibited by law, by entering a Drawing or by winning, entrants grant to the Sponsor the right to publicize the entrant’s name, photograph, image, likeness, voice, statements, and biographical information in all manner and media, worldwide, in perpetuity, for advertising, trade, and promotion purposes without compensation and without opportunity for review. Limitations of Liability: The Sponsor, its employees, agents and representatives, officers and directors and their immediate families, successors and assigns, and all others associated with the development and execution of a Drawing shall have no responsibility or liability for (i) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in a Drawing; (ii) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in telephone lines or network hardware or software; (iii) unauthorized human intervention in any part of the entry process or a Drawing; (iv) technical or human error which may occur in the administration of a Drawing; or (v) failed, incomplete, garbled, jumbled, corrupted, or delayed computer transmissions which may limit an individual’s ability to enter a Drawing, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from entering a Drawing or downloading any materials related to a Drawing. Entrant’s Personal Information: Information collected from entrants will be maintained by the Sponsor and its representatives in accordance with applicable federal and state consumer privacy laws, rules, and regulations.
